Welcome to Best Senior Living. These Terms and Conditions ("Terms") are a legal agreement between you and Digital Tales LLC, doing business as Best Senior Living ("Best Senior Living," "we," "us," or "our"). They govern your use of our websites, online courses, web applications, downloadable materials, consulting services, and any other products or services we offer (together, the "Services").
Please read these Terms carefully. By accessing or using any of our Services — including by buying a product, creating an account, or using one of our tools — you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
This is the most important part of these Terms. Please read it closely.
Best Senior Living provides educational and informational products and general guidance to help families understand senior care and senior living decisions. We are not a law firm, a financial advisor, a medical provider, an insurance agency, or a senior placement agency, and we do not provide legal, financial, medical, tax, or other professional advice.

Our courses, web applications, tools, scores, summaries, checklists, guides, and any output you receive (including anything produced with the help of artificial intelligence) are for general educational purposes only.
Nothing we provide is a substitute for advice from a licensed attorney, financial advisor, medical professional, or other qualified expert who knows the details of your specific situation.
We do not review contracts as your legal representative, and using our tools does not create an attorney-client relationship or any other professional relationship.
Senior living contracts, laws, and rules vary by state and change over time. A tool cannot catch everything, and a result from our Services is not a guarantee that a contract is safe, fair, complete, or right for your family.
Before you sign any contract or make any major care, legal, or financial decision, you should have it reviewed by a qualified professional licensed in your state.
You are responsible for your own decisions. You agree that any action you take based on our Services is your choice and your responsibility, and that you assume the risks involved. To the fullest extent allowed by law, we are not responsible for the outcome of any contract you sign, any decision you make, or any agreement you enter into.
You must be at least 18 years old and able to enter into a binding contract to use our Services. By using the Services, you confirm that you meet these requirements and that the information you give us is accurate.
Our Services are intended for individual consumers and families. They are not designed or licensed for use by senior living businesses, operators, or other companies, except under a separate written agreement with us (such as our affiliate program described in Section 13).
Some Services require an account. You agree to keep your login details private, to be responsible for everything that happens under your account, and to tell us right away if you suspect unauthorized use. Accounts are personal to you. You may not share, sell, or transfer your account or login to anyone else.
Pricing. Prices for our Services are shown at the point of sale. We may change prices at any time, but changes will not affect orders you have already completed.
Order bumps and upsells. During checkout or afterward, we may offer additional products (such as add-ons, upgrades, or related tools). You only pay for items you choose to buy.
Payment. Payments are processed by a third-party payment processor. By making a purchase, you authorize us and our processor to charge your chosen payment method for the total amount, including any applicable taxes. You agree to provide current, complete, and accurate payment information.
Taxes. You are responsible for any sales or other taxes that apply to your purchase.
Subscriptions (if offered). If any Service is sold on a recurring basis, the billing cycle and renewal terms will be disclosed at purchase. Recurring charges continue until you cancel as described at the point of sale or in your account.
Because our digital products give you immediate access to valuable materials, the following refund terms apply:
Courses and digital products (including downloadable guides and tools): Unless stated otherwise on individual course or digital product sales pages, we offer a 3-day satisfaction guarantee. If you are not satisfied within 3 days of purchase, contact us at the email below for a full refund. Some courses and digital products may have longer term satisfaction guarantees as described on their individual sales pages.
Web applications: All sales are final and non-refundable once access is granted
Consulting services: Deposits are non-refundable. You may reschedule a session with at least [NUMBER] hours' notice. Sessions canceled with less notice, or missed without notice, may be forfeited. Fees for services already delivered are non-refundable.]
To request a refund or cancel, contact us at [email protected]. We may verify your purchase before processing any refund. Refunds are returned to the original payment method.
When you buy or access a course, web application, downloadable tool, or other digital product, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use it for your own personal, non-commercial purposes and for the care of your own family.
You may not:
Copy, share, resell, redistribute, sublicense, or publicly post our content or your account access.
Use our content to provide services to others, to train artificial intelligence systems, or for any commercial purpose.
Remove or alter any copyright, trademark, or other notices.
Try to copy, reverse engineer, scrape, or extract the underlying code or design of our web applications.
This license ends if you violate these Terms.
All content and materials we provide — including text, courses, videos, tools, software, web applications, designs, logos, and the "Best Senior Living" name — are owned by us or our licensors and are protected by copyright, trademark, and other laws. © 2025 Digital Tales. All rights reserved. Except for the limited license in Section 6, we keep all rights. Nothing in these Terms gives you any ownership of our content.
Some Services let you enter information, upload documents, answer questions, or save notes (for example, contract details and family information you enter into a web application). You keep ownership of the information you provide ("Your Content").
By providing Your Content, you give us a license to store, process, and use it as needed to operate the Services and deliver your results — including processing it through service providers and artificial intelligence tools as described in our Privacy Policy. You confirm that you have the right to share any information you provide, including information about another person, such as a family member.
Sensitive information. Some Services ask for sensitive details about a care or financial situation. You choose how much to enter. Please review our Privacy Policy to understand how this information is handled.
Feedback. If you send us ideas, suggestions, or feedback, you agree we may use them freely without owing you anything.
You agree not to:
Use the Services for any unlawful purpose or in violation of these Terms.
Interfere with or disrupt the Services, servers, or networks, or try to gain unauthorized access.
Upload viruses, malicious code, or harmful content.
Use the Services to harass, harm, or impersonate others.
Misrepresent your identity or your authority to act for another person.
Use automated tools to access, scrape, or copy the Services without our permission.
We may suspend or end your access if you violate this section.
Our Services may rely on or link to third-party platforms, tools, and websites that we do not control (such as payment processors, email and hosting providers, and the platforms where we publish content). We are not responsible for third-party services or their content, and your use of them is governed by their own terms and privacy policies.
To the fullest extent allowed by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, secure, or that any result, score, or output will be accurate, complete, current, or suitable for your situation. Any reliance you place on the Services is at your own risk. See Section 1.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
To the fullest extent allowed by law:
We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Services.
We will not be liable for any loss or harm arising from a contract you sign, a decision you make, or an outcome with any senior living community, provider, or third party.
Our total liability for all claims relating to the Services will not exceed the amount you paid us for the specific Service that gave rise to the claim during the twelve (12) months before the claim arose.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
We may operate an affiliate or referral program that lets approved businesses and partners promote our Services in exchange for a commission or other compensation. Participation requires acceptance of a separate Affiliate Agreement, which governs commissions, tracking, payment, and conduct. Affiliates are independent and are not authorized to make promises, set prices, or act on our behalf. These consumer Terms continue to apply to anyone who purchases through an affiliate link. See our Privacy Policy for how referral information is handled.
You agree to defend, indemnify, and hold harmless Best Senior Living, its owners, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Services, Your Content, your violation of these Terms, or your violation of any law or the rights of any third party.
Governing law. These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.
Informal resolution first. Before starting any formal proceeding, you agree to contact us at the email below and give us at least 30 days to try to resolve the dispute informally.
Venue. Unless an arbitration clause applies, you agree that any dispute will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction.
We may suspend or end your access to the Services at any time if you violate these Terms or for any other reason allowed by law. You may stop using the Services at any time. Sections that by their nature should survive termination — including Sections 1, 7, 8, 11, 12, 14, and 15 — will continue to apply.
We may update these Terms from time to time. When we do, we will change the "Last Updated" date above. If the changes are significant, we will provide a more noticeable notice. Your continued use of the Services after an update means you accept the updated Terms.
By using the Services, you agree that we may communicate with you electronically, and that electronic notices, agreements, and records satisfy any legal requirement that such communications be in writing.
Entire agreement. These Terms, our Privacy Policy, and any agreement you accept at purchase make up the entire agreement between you and us regarding the Services.
Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to do so later.
Assignment. You may not transfer your rights under these Terms. We may assign ours in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control.
Headings. Section titles are for convenience only and do not affect the meaning of these Terms.
